1. Data privacy policy
Data privacy is taken very seriously at the Böllhoff eShop.
We respect and value your right to retain control over information belonging to you, the need to protect personal data and the principle of “lean data”.
Our privacy practices adhere to the strict requirements of the “Commission Nationale Informatique et Liberté“ or CNIL.

By declaring your consent to this Data Privacy Policy, you consent to the collection, processing and use of your personal data in accordance with the following provisions and guidelines.

2. Definitions
2.1.
Personal data is specific information concerning personal or material circumstances of an identified or identifiable individual (data subject).

4. Objection

5. Which data do we store, and for which purposes?
5.1. Going to our website at www.eshop.boellhoff.fr
 
When you access pages on our website at eshop.boellhoff.fr, we save the following standard log files for technical reasons:
   • IP address of the accessing computer ;
   • Browser type and browser settings ;
   • Your operating system ;
   • Date and duration of the visit ;
   • The website from which you access the site www.eshop.boellhoff.fr ;
   • The specific pages accessed.
 
5.2. Registration
In order to be able to order goods from the Böllhoff B2B eShop, you must first register.
Registration also means an access control mechanism, as the Böllhoff eShop is aimed exclusively at businesspeople and merchants or traders.
When registering, we collect, process and use the following data:
 
   • Email address
   • Your chosen password
   • First name
   • Last name
   • Company
   • Street
   • House number
   • Post code
   • City
   • Country
   • VAT ID number
   • Phone no.
   • Cell phone no.
   • Telefax no.
 
Giving your phone, telefax or cell phone numbers is made on a voluntary basis.
Your email address is also your user name.
We check the data upon entry for completeness and accuracy, and also check the validity of your address and VAT identification number.
The login data is also stored, i.e the combination of your email address and the password of your choice.
We also store any messages from you to us concerning your order.
 
5.3 What do we need the data for?
The log files are stored for security reasons for a maximum of 1 week in order to protect the safety of the data processing system.
 
We require the data collected during registration firstly for purposes of controlling access to the Böllhoff eShop and also in order to accept, process and deliver your order, or if you wish to procure any additional services.
 
To process your order, Böllhoff stores your order address and delivery address (if different).
Phone, telefax and email details help us to contact you quickly in the event of any queries or notifications concerning your order.
Where a file is downloaded (pls refer to our Terms of Use), Böllhoff stores for security purposes (security of data and prevention of legal abuses) your IP address, the name of the user logged in, the date and time, and the files downloaded.
We will also use your address details for sending information retrieved by you concerning Böllhoff products.
 
We will also use your email address for sending you our newsletter if you have subscribed to it. You may unsubscribe to this at any time (pls refer to Section 11).
We will also make use of your data where BÖLLHOFF is legally obliged to, for example as a result of a government agency regulations or a court order and for purposes of safeguarding our rights and our legal defense.
 
6. With whom will your personal details be shared?
Your personal details will not be disclosed to third parties unless you have given us the corresponding consent. An exception to this is disclosure to service partners, such as parcel delivery and or forwarding agents, where disclosure is necessary for purposes of processing the order and/or delivering the goods.
The logistics service providers are given the sole data necessary for delivery for use at their own responsibility. In so doing, we restrict ourselves to disclosing data necessary for shipment purposes, in keeping with the principles of data privacy and minimisation of data (“lean data”). These external service providers are carefully selected by Böllhoff.
 
In addition, other service providers may act for Böllhoff in terms of contract negotiations and contract management, such as IT service provider or the hosting service for the website  www.eshop.boellhoff.fr . 
These companies act for Böllhoff under what is known as a contracted-out data processing arrangement and may only use personal data in accordance with our instructions.
Contractually, Böllhoff has set these providers under obligation as per French data protection standards and monitors compliance.
 
Another exception is transmission of data for purposes of order processing or delivery of goods and services or for accounting and billing purposes within the Böllhoff Group, i.e. to companies within the Böllhoff Group.
 
In all these cases, transmission is performed in accordance with the provisions of the “Commission Nationale de l'Informatique et des Libertés“ or CNIL; in so doing the volume of data transmitted is limited to the minimum necessary.
 
7. Security of data
When it comes to protecting your personal data, at Böllhoff the very highest data security is the order of the day.Technical and organizational measures are taken to ensure that data collected, processed and used by us is safeguarded against unauthorized third party access.
Communication is effected via SSL encryption.
 
8. Credit checking
If you select the “Pay by invoice” payment option when placing your order, we may perform a credit check in order to protect our legitimate interests. In addition to the data available to us, such as order history, data may potentially be required from external service providers. In doing so, we will supply the information necessary for performing a credit check with the Finance Department of Böllhoff Otalu SAS under the responsibility of our CFO.
 
The Finance Department will use the data and apply mathematical and statistical methods to arrive at an appropriate credit rating for you for the applicable and relevant order. We use the statistical result concerning the possibility of default solely and exclusively for the decision whether or not to execute the order under the “Pay by invoice” payment method selected by you.
You may require the above service provider at any time to provide details of the data held on you, using the above contact details.
You may lodge an objection at any time to a credit check and to the transfer of data to the credit checking service provider. To do so, please contact us by email, fax, post or telephone. Contact details may be found in Section 4. Böllhoff then reserves the right to refuse payment by invoice in such case.
 
9. Cookies
We use cookies to make the Böllhoff eShop simple and convenient to use. Cookies are small files that are stored on your disk and store the data to be exchanged with our electronic trading system.
Some of the cookies used by us are deleted automatically after the browser session is terminated, others remain on your disk in order, for example, to recognise you quickly on your next visit to the Böllhoff eShop and facilitate your use of it.
You can use a browser setting to ensure that your browser notifies you when cookies are being used, allowing you to reject or accept them. Rejection may result in limited user functionality on our website.
 
10. Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses so-called cookies, text files that are stored on your computer and enable analysis of your use of the website. The information generated by the cookie about your use of this website are usually transferred to a Google server in the US and stored there. Where IP addresses are rendered anonymous on this website, 
 
Google will first truncate/ shorten your IP address within member states of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional circumstances will the full IP address be transferred to a Google server in the US and be truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity and provide other services related to website usage and Internet usage to the website operator. The IP address transmitted by your browser under Google Analytics will not be merged with other data in Google's possession.
 
You may prevent the storage of cookies by adjusting your browser software accordingly; however, we point out that doing so may potentially imply that you will not be able to use all features of this website. If you wish to prevent the collection of data by Google Analytics, you may register your disagreement via the opt-out link and disable the collection of data. This deactivation process is stored in the cookies. Please note that this setting is lost when you delete the cookie. You may also prevent collection by Google of the data generated by the cookie and relating to your use of the website (including your IP address) by downloading and installing the available browser plug-in.
 
11. Newsletter
The newsletter subscription is independent of registration in the Böllhoff eShop. To receive our newsletter, it needs to be ordered separately.
 
If you subscribe to our newsletter or other information material, we will store your email address and the personal details entered by you in the “logon screen”. Data is entered on a voluntary basis. The email address must, however, be given in order to perform the double-opt-in procedure, as the newsletter can only be sent to the email address specified by you once the activation link sent to you has been clicked on.
 
If you do not wish to receive our newsletter any more, simply click on the unsubscribe link at the end of each newsletter. The “unsubscribe link” can be found in every newsletter.
Alternatively, you can also send us an email or give us a call or send us a fax or write us a letter for purposes of cancellation. Contact details are to be found in Section 4 above.
 
12. Form and contact form
When an electronic form provided on our website is used, we will collect, store and process your data only for purposes of processing your request and only to the extent necessary and where this is required for purposes of corresponding with you.
 
13. Notification, correction, blocking and deletion of personal data
Within the legal framework of the CNIL, you have a right to access to given information, free of charge, concerning data stored on you, and you shall be entitled to correct, block and delete such data. Where legal or contractual retention periods, retention periods prescribed by commercial or tax legislation or other reasons founded in law mitigate against deletion, your data will be blocked instead of being deleted.
The data will be deleted once the objective pursued by the collection, processing and storage of the data has been completed.
You may obtain information at any time on the data stored by Böllhoff.
